I will present from several aspects - the relationship of the legal system with the government, its relationship with the public and the factors of incitement in the public, its resilience from bias and the bias of justice, and pluralism in a system that is not monolithic. attitude to the courtsThere is a separation of authorities and independent courts, also because this is what the law says, and also in practice we see independence and activism that has only increased in recent years. An example is the Tal Law for the recruitment of Yeshiva students, which was enacted under pressure from the High Court of Justice, which forced the state to regulate the issue of recruitment. I will not go into the details of the law, but the Knesset had to decide because Begetz demanded of it. Regarding incitement, we saw that there is a lot of struggle by the system against incitement systems that demand to change sentences or pardon them, and in the end this did not happen. Even in the case of the massacre in Shafram by the Jewish terrorist, the perpetrators were arrested and prosecuted, despite the system of incitement against the law. Integrity of office bearersRegarding integrity - there are almost no cases of bribery towards police officers or judges. It can be compared to Turkey or Eastern Europe where it is absolutely possible that you will not receive a report because you will pay a bribe. In Israel this does not exist because if you are arrested for an offense you will receive a report. There are also many cases of judges disqualifying themselves on their own initiative, for example Eliak Rubinstein. Regarding pluralism, we see today that there are two main failures of two legal systems, and that this will dismantle the system. In practice, we see that this did not happen and the system got stronger. As a result, there is more balance in the committee for appointing judges and the system has only gotten stronger. In conclusion, I showed that the system in Israel is strong and independent and only got stronger in recent yearsRegister now for the public discussion |
